Am I Eligible To Make A Claim If The Driver Is Uninsured?

If you had a collision with an uninsured driver through no fault of your own, you may be eligible to claim compensation. However, the process can be more complicated. You can make a claim on your own insurance but this will likely result in higher premiums and paying a large excess. A better alternative is to apply through the Motor Insurance Bureau (MIB) who provide compensation to victims of uninsured and untraceable drivers.

Road traffic accidents (RTAs) can have a huge impact on your day-to-day life. From vehicle repairs to loss of earnings, it can put you under financial pressure which compensation can help you pay for. There can also be medical costs such as travel expenses or changes to your home as a result of injuries from the accident. Common injuries in RTAs include:

Everyone has a duty of care to make the roads safe for everyone. If this has been breached due to driver negligence and you have been injured as a result, you can claim compensation, whether the defendant has insurance or not.

The time it takes for a claim to be processed and compensation to be paid by the MIB does depend on the complexity of the case. If your case is fairly straightforward, it may take a few months but if it’s more complicated, it could take a lot longer. How To Make An Uninsured Driver Claim

When making a claim through the MIB, it’s important to gather as much evidence as possible. This will help to strengthen your case and give your solicitor what they need to win you the best outcome.

The first thing to do is to report the RTA to the police immediately and get a crime reference number. If the accident caused damage to any property or any vehicle, the RTA should be reported to the police within 5 days of the accident. If the accident caused injury but no damage to any property or vehicle, the RTA should be reported to the police within 14 days.

After this you can start to gather evidence both about the injury and the accident. This can include:

  • The defendant’s car details – if it’s possible, note down the make, colour and In addition, be sure to take note of any verbal exchanges and the damage on both vehicles.
  • Medical reports – prescription receipts and a report from your doctor about your injuries can help prove how the accident impacted your life.
  • Written statement – try to do this as soon as possible while the events are still fresh in the mind.
  • CCTV or dash cam footage of the accident – it’s important to note you are legally entitled to request CCTV footage.
  • Photos of the scene and your injuries – this will help to keep a clear record of what happened and the severity of your injury.

Fees And Compensation

You can make a compensation claim to the MIB with the help of an experienced solicitor and it won’t cost you any money. Many solicitors operate on a ‘no win, no fee’ basis. This means you don’t pay anything if your case is unsuccessful. If you are successful with the uninsured driver compensation claim, then your solicitor will be awarded a small percentage of your compensation amount. This can’t legally be more than 25%.

The amount of compensation can be hard to predict as it depends on your own circumstances and a number of different factors including:

  • Physical injuries
  • Loss of earnings
  • Psychological impact
  • Medical treatment costs
  • Impact on your quality of life.

How Long Do I Have To Make A Compensation Claim?

As with all personal injury claims, there is a three year time limit on making a claim, meaning it’s important to start your claim as soon as possible. The MIB may also cover private medical treatment, helping to speed up your recovery process so the sooner you can make a claim, the better.
